Driving Safety Course

You are eligible for a Driving Safety Course if:

  1. You have a valid Non-CDL Texas Driver’s License,

  2. You have evidence of Texas financial responsibility (liability insurance),

  3. You are not charged with speeding in excess of 24 miles per hour over the speed limit,

  4. You are not charged with a violation occurring in a construction zone,

  5. You have not taken a Driving Safety Course within the last 12 months to dispose of a citation. (Calculated from the date of course completion to the date of your current citation.

You are NOT eligible for the Driving Safety Course if  you received a 10-day extension. 

If you are eligible you may sign up for a Driving Safety Course by providing the following to the Court: 

  1. Required fee:
    Violations not occurring in School Zone                       $  112.00
    Violations occurring in a School Zone                          $  137.00

  2. A copy of your valid Texas Driver’s License.

  3. A copy of your liability insurance card or other evidence of the required financial responsibility.

  4. The Driving Safety Affidavit form below (completed).

  5. The Driving Safety Request form below (completed).


Important: Your request must be received by the court on or before the response date at the bottom of your citation.

I wish to enter a plea of NO CONTEST, waive my right to a jury trial and request a 90 day extension to complete a Driving Safety Course.  I understand that this plea enters a guilty judgment and this judgment will be removed and no conviction will appear on my record upon submitting proof of completion of the course. I FURTHER UNDERSTAND THAT FAILURE TO COMPLY WILL RESULT IN ASSESSMENT OF THE FINE AND A CONVICTION ON MY DRIVING RECORD.

Driving Safety Affidavit

Now comes the Defendant in the above styled and numbered case and requests that he/she be granted a 90 day extension to complete a Driving Safety Course, and that in support of the Defendant’s application would show the court the following:

  1. That I am not in the process of taking Driving Safety for another ticket (Under 45.0511 CCP)

  2. If I have taken driving safety before under this section, I completed that driver’s safety course at least one year before the date I received this ticket.

THE ABOVE FIVE (5) ITEMS, MUST BE MAILED ON OR BEFORE YOUR RESPONSE DATE.  LATE OR INCOMPLETE REQUESTS WILL BE REJECTED.  A REPLY WILL BE MAILED TO THE ABOVE ADDRESS.  IF YOU FAIL TO RECEIVE A RESPONSE WITHIN 2 WEEKS CALL THE COURT OFFICE.  REMEMBER TO ENTER A PLEA ON THE REQUEST FORM.

Printable Show Cause Waiver form

If you signed up with the court to take a Drivers Safety Course to dismiss a citation but failed to complete the course on time, you may avoid appearing in court by printing out the Show Cause Waiver form, completing it and returning it to the court along with a payment of $200.00. If you chose to do this your citation will go to conviction and will be reflected on your record.
