Carrollton to Hold Public Meeting on Downtown MSD Application

Part of the Downtown Carrollton redevelopment efforts that began in summer 2015 includes securing a Municipal Setting Designation (MSD) certification from the State. The City of Carrollton intends to apply for an MSD to further improve the area’s property values. A public meeting to discuss the application is set for Monday, March 27 in Carrollton.

The MSD certification, together with the 2015 Downtown improvements which included additional parking around the Square, installation of 33 new trees, new lighting, two new fountains, new grass, the addition of a site-wide Wi-Fi network, and upgrades at the adjacent Pioneer Park, would increase property values for area residents and businesses. Properties are more attractive to economic drivers when remediation issues are resolved and certified.

The purpose of an MSD is to restrict the use of groundwater beneath a site for potable purposes. Responding to legislation from the Texas Commission on Environmental Quality (TCEQ), the City passed an ordinance that allows a property owner to limit or avoid conducting a clean-up of contaminated groundwater if access to the groundwater beneath that property has been restricted from use as potable water. The ultimate goal of any MSD is to encourage the continued development and use of property or redevelopment of vacant or abandoned commercial/industrial properties while protecting human health.

As is required by the City’s newly passed ordinance, a public meeting regarding the City’s application will be held on Monday, March 27 from 7-8 p.m. at Josey Ranch Lake Public Library (1700 Keller Springs Road).  Additionally, a public hearing on the application is scheduled to be heard during the City Council Meeting on Tuesday April 18, at 7 p.m. at City Hall (1945 E. Jackson Road).

According to the TCEQ, a property is eligible for an MSD if:

  1. It is within the corporate limits or extraterritorial jurisdiction of a municipality that has a population of at least 20,000.
  2. A public drinking water supply system exists that satisfies the requirements of the Texas Health and Safety Code Chapter 341 and that is capable of supplying drinking water to the property for which the MSD is requested. 

The 220-acre Downtown Carrollton MSD area, which includes the former Texaco gas station (1309 S. Broadway) that the City purchased in late 2015, meets both of these requirements.   

The MSD status is particularly important to Downtown Carrollton development projects like Monkey King Noodle Co. which recently opened in the completely renovated former gas station and was later joined by well-known mobile vendor Cow Tipping Creamery. Converting the space from a gas station/auto repair shop into a restaurant proved imperative for the City to ensure clean drinking water at the site. Additionally, the MSD will support the development of Phase III of the Union at Carrollton Square Apartments. A portion of the site was formerly a tile yard, with crushed up bits of tile and debris littering the ground. The ability to ensure clean water for the future residents of Phase III is crucial.

Carrollton isn’t unique in applying for an MSD. Similar applications have been filed with TCEQ, such as the City of Denton’s 890-acre Downtown Corridor development approved in 2015; the Trinity Groves entertainment destination in Dallas approved in 2007; and other large regional sites such as Downtown Fort Worth, Love Field Airport, and Singleton Boulevard in Dallas.

This application sets the stage for what is essentially a redevelopment tool that the State of Texas saw fit to offer municipalities with qualifying areas. Property owners in the area no longer have to expend time or money to pursue the redevelopment of their individual properties and filing their own MSD application as this City-sponsored application is a budgeted item from 2015.

Cirrus conducted sample testing over the course of nearly one year to verify the stability of the region that no contamination had or could spread.
