House Bill 1295, passed by the Texas Legislature in 2015, added Section 2252.908 to the Texas Government Code. This law ensures transparency in government contracts by requiring businesses to disclose the individuals or entities that have a financial interest in a contract before it is finalized.

Key Points:

  • Disclosure of Interested Parties: A business entering into a qualifying contract with a government entity must submit a disclosure form identifying those with a financial interest in the contract.

  • When It Applies:
    • If the contract requires approval by a governing body (e.g., City Council, board of directors).
    • If the contract is worth at least $1 million.

  • Effective Date: The disclosure requirement applies to contracts entered into on or after January 1, 2016.

This law is designed to increase transparency and accountability in government contracting by ensuring that decision-makers and the public are aware of potential conflicts of interest before a contract is executed.
